The ICE I-983 form plays a critical role in the Optional Practical Training (OPT) program for international students in the United States. This form, known as the "Training Plan for STEM OPT Students," is essential for students seeking to extend their work authorization in a STEM field. It outlines the training objectives, the employer's responsibilities, and the student's goals during the training period. Additionally, the form requires detailed information about the employer, including their commitment to providing mentorship and a structured training experience. Students must also explain how their work relates to their degree and how it will help them achieve their professional objectives. Accurate completion of the I-983 is vital, as it must be submitted to the U.S. Citizenship and Immigration Services (USCIS) as part of the application process for a 24-month extension of OPT. Failure to comply with the requirements can lead to complications in maintaining legal status in the U.S. and may affect future immigration benefits.

Similar forms

  • Form I-20: Similar to the I-983, Form I-20 is used by F-1 students to apply for and maintain their student status. Both forms require detailed information about the student's program and the institution, ensuring compliance with U.S. immigration regulations.

  • Form DS-2019: This document is utilized for J-1 exchange visitors. Like the I-983, it outlines the purpose of the program and the participant's responsibilities. Both forms are essential for maintaining lawful status in the U.S.

  • Form I-765: This application for employment authorization is similar in that it is a necessary step for individuals seeking to work in the U.S. Both forms require personal information and details about the applicant's situation.

  • Form I-94: The I-94 form records the arrival and departure of non-citizens in the U.S. Like the I-983, it helps track an individual's status and compliance with immigration laws.

  • Texas Real Estate Purchase Agreement: This form is vital for ensuring clarity in real estate transactions, as it defines the responsibilities and expectations of all parties involved, further supported by resources available at https://freebusinessforms.org/.
  • Form G-28: This form is used to designate an attorney or accredited representative to act on behalf of an applicant. Similar to the I-983, it ensures that the proper channels are followed in immigration processes.

  • Form I-129: This petition for a nonimmigrant worker is akin to the I-983 in that it outlines the terms of employment and the qualifications of the applicant. Both forms are critical in the employment-based visa process.

Documents used along the form

The ICE I-983 form, officially known as the "Training Plan for STEM OPT Students," is essential for international students seeking to extend their Optional Practical Training (OPT) in the United States. However, several other documents often accompany this form to ensure compliance with U.S. immigration regulations and to provide a complete picture of the student's training and employment situation. Below is a list of these important forms and documents.

  • Form I-20: This is the Certificate of Eligibility for Nonimmigrant Student Status. It is issued by the educational institution and outlines the student's program of study and eligibility for OPT.
  • Form I-765: This is the Application for Employment Authorization. Students must submit this form to apply for work authorization during their OPT period.
  • Form I-94: This is the Arrival/Departure Record that indicates the student's immigration status and length of stay in the U.S. It is crucial for verifying the student's eligibility for OPT.
  • Employer Letter: A letter from the employer detailing the job offer, including the position, duties, and how the job relates to the student’s field of study. This helps to confirm that the employment is relevant to the student’s degree.
  • Job Description: A detailed description of the job responsibilities and tasks that the student will perform. This document is vital for demonstrating how the position aligns with the training plan outlined in the I-983 form.
  • Performance Evaluation: A document that outlines how the student’s performance will be assessed during the training period. This evaluation is important for maintaining compliance with the training plan requirements.
  • Training Agreement: A formal agreement between the student and the employer outlining the expectations and responsibilities of both parties during the training period.
  • Trailer Bill of Sale: To officially record the sale and purchase of a trailer in Georgia, it is essential to fill out the download the document in pdf accurately, ensuring that the transfer of ownership is legally recognized.
  • Proof of Employment: Documentation that verifies the student's employment status, such as pay stubs or an employment verification letter, which may be required for ongoing compliance with immigration regulations.
  • SEVIS Fee Payment Receipt: A receipt showing that the student has paid the SEVIS fee, which is necessary for maintaining their student status and eligibility for OPT.

Collectively, these documents provide a comprehensive overview of a student's eligibility and readiness for the STEM OPT extension. Ensuring that all required forms are completed accurately and submitted on time is crucial for a successful application process. Each document plays a specific role in demonstrating compliance with U.S. immigration laws and the relevance of the training experience to the student's academic background.

Misconceptions

The ICE I-983 form, also known as the Training Plan for STEM OPT Students, is often misunderstood. Here are eight common misconceptions about this important document:

  • It is only for students in engineering fields. The I-983 form is not limited to engineering students. It is applicable to all STEM (Science, Technology, Engineering, and Mathematics) fields, including biology, mathematics, and computer science.
  • Employers do not need to be involved in the process. In reality, employers play a crucial role in completing the I-983. They must collaborate with students to outline the training plan and ensure it meets the necessary requirements.
  • Once submitted, the I-983 cannot be changed. This is incorrect. If there are significant changes to the training plan or the employer's information, students can and should submit a new I-983 to reflect those changes.
  • Only the student can fill out the form. While the student is responsible for submitting the form, input from the employer is essential. Both parties must work together to create an effective training plan.
  • The I-983 is not reviewed by anyone. This is a misconception. The form must be reviewed by the Designated School Official (DSO) at the student’s institution before it is submitted to the U.S. government.
  • It is a one-time requirement. The I-983 must be updated and resubmitted whenever there are changes in the training plan or if the student changes employers during their STEM OPT period.
  • Students do not need to keep a copy of the I-983. It is important for students to retain a copy of their I-983 for their records. This can be helpful for future applications or if questions arise about their training.
  • The I-983 guarantees job placement. Completing the I-983 form does not guarantee employment. It simply outlines the training plan and requirements for students on STEM OPT.
